Areas of Practice

Wendi S. Temkin practices in the areas of intellectual property (including copyright, trademark, trade dress, trade secret, Web site infringements and other Internet-related disputes), and complex civil litigation (including breach of contract, interference with contract, breach of fiduciary duty, conspiracy, fraud, fraudulent transfer, trespass, theft of trade secrets, and negligence).

She has represented clients in Colorado state courts and the U.S. District Courts in Colorado and Ohio, in numerous state courts across the country (through pro hac vice admission and/or with the association of local counsel), and in arbitration proceedings nationwide.   

Representative cases

  • Ms. Temkin was part of a legal team that successfully defended a breach of contract and gross negligence claim filed as an arbitration demand in Bend, Oregon against Dex Media, Inc., a long-standing firm client.  The claimant sought damages of $408,188.  The AAA arbitrator ruled in favor of GDH’s client on all issues, awarding $0 in damages.  Ms. Temkin drafted a series of briefs on complex legal issues in this case, including one in which she persuaded the arbitrator that an appellate court decision directly on point was incorrectly decided.   
  • Ms. Temkin also represented Dex Media in an arbitration proceeding in Albuquerque, NM, where she obtained a directed verdict dismissing claims of fraud and unfair business practices against the company.  After a hearing on the merits, Dex was awarded damages on its breach of contract counterclaim.  The arbitrator’s judgment included interest on the contract amount, as well as all attorney’s fees and costs incurred.     
  • Ms. Temkin was part of a legal team that successfully obtained injunctive relief for a client whose former business partner opened a competing business and attempted to use client lists and other trade secrets stolen from GDH’s client. 
  • Ms. Temkin helped obtain monetary damages and injunctive relief for an artist whose copyright-protected works had been infringed by a craftsperson and three catalog publishers located throughout the country.  Monetary damages obtained significantly exceeded the actual damages suffered.    
  • Ms. Temkin helped obtain injunctive relief in a defamation action brought on behalf of a client whose reputation and business had been maligned by a competitor’s negative postings on the Internet.    
  • Ms. Temkin was part of a legal team that negotiated a favorable settlement on behalf of a client who was the victim of religious discrimination and severe bullying during his years at a public charter school.      

In addition to her litigation practice, Ms. Temkin assists clients in protecting their original works through registration with the U.S. Copyright Office, and the U.S. Patent and Trademark Office, and advises clients on matters related to employment agreements and various other contract issues.

Education

Ms. Temkin received her Juris Doctorate from the Boalt Hall School of Law at the University of California, Berkeley in 1991. While there, she received the American Jurisprudence Award and held an externship with Judge Roderic Duncan.

In June 1984, Ms. Temkin received a Bachelor of Arts in English from the University of California, Los Angeles. She graduated magna cum laude and was selected to be a member of the Phi Beta Kappa society.

Bar and Professional Activities 

Ms. Temkin was admitted to the California Bar in December 1991. She has been a licensed member of the Colorado Bar since May 2005, and was admitted to practice before the United States District Court for the District of Colorado in 2007 and the United States District Court for the Southern District of Ohio in 2009. Ms. Temkin is a member of the Boulder and Colorado Bar Associations. 

Ms. Temkin sits on the board of The Art Underground, a non-profit organization located in Louisville that offers visual and performing arts education, performance space, and support to the local arts community.  

Ms. Temkin spent four years as a writer and editor for Emanuel Law Outlines. While there, she authored a study guide on Tax Law and edited and updated the company’s titles on Contracts, Professional Responsibility, Criminal Procedure, and Torts.

Prior to moving to Colorado, Ms. Temkin spent four years as an associate with the firm f.k.a. Friedman, Ross and Hersh, PC, a boutique litigation and domestic relations law firm in San Francisco, California.
